By using the 33HelpME Service, you agree to comply with this Content Policy.
Related Policies: This Content Policy supplements and is incorporated into our Terms of Service and End User License Agreement.
2. ACCEPTABLE USE OF THE SERVICE
2.1 Intended Use
The 33HelpME Service is designed to:
Enable End Users to request assistance (emergency or non-emergency) at venues by scanning QR codes
Route alerts to venue operators’ designated personnel (Command Center and/or Response Team)
Provide reporting and analytics on alert activity
Facilitate communication between End Users and venue response personnel
2.2 Appropriate Uses
Customers (Venue Operators) may use the Service to:
Receive and respond to assistance requests from End Users
Monitor alert activity at their venues
Generate reports for security, operations, or compliance purposes
Train personnel on alert response procedures
Configure and manage alert routing
End Users may use the Service to:
Request assistance for legitimate emergencies (medical, security, safety)
Request assistance for non-emergency matters (maintenance, lost items, information, accessibility needs)
Report concerns or incidents at venues
Contact venue personnel when help is needed
3. PROHIBITED ACTIVITIES
3.1 Unlawful Activities
You may NOT use the Service to:
Engage in or facilitate any illegal activity
Violate any federal, state, or local laws or regulations
Infringe on intellectual property rights of 33 Systems Inc., d/b/a 33HelpME, or others
Violate export control laws or regulations
Transmit or facilitate the transmission of illegal content
3.2 Abuse and Misuse
You may NOT:
Make false alerts or reports (e.g., fake emergencies, hoax threats, prank alerts)
Harass, threaten, or intimidate others through the Service
Spam or flood the Service with excessive or repetitive alerts
Attempt to overwhelm or disable the Service (e.g., denial-of-service attacks)
Impersonate others or provide false identity information
Use the Service to stalk, track, or monitor individuals without authorization
Interfere with venue operations or emergency response
3.3 Prohibited Content
When using the Service, you may NOT transmit or input content that:
Is threatening, abusive, harassing, defamatory, or hateful
Promotes violence, discrimination, or harm against individuals or groups
Contains explicit sexual content or child exploitation material
Promotes illegal drugs, weapons, or criminal activity
Contains viruses, malware, or other harmful code
Infringes on copyrights, trademarks, or other intellectual property rights
Violates privacy rights or discloses personal information of others without consent
3.4 Technical Restrictions
You may NOT:
Attempt to gain unauthorized access to the Service, systems, or networks
Reverse engineer, decompile, or disassemble the Service software
Remove, alter, or obscure QR codes without Customer authorization
Use automated tools (bots, scripts) to scan QR codes or access the Service
Interfere with or disrupt the Service, servers, or networks
Attempt to bypass security measures or access restrictions
Collect or harvest data from the Service using automated means
Resell, sublicense, or redistribute the Service without authorization
3.5 Misuse of End User Information
Customers may NOT:
Use End User information for purposes other than responding to alerts and providing reports
Share or sell End User information to third parties (except as required by law)
Use End User information for marketing or advertising without consent
Retain End User information longer than necessary for legitimate business purposes
Fail to protect End User information with reasonable security measures
4. CONSEQUENCES OF VIOLATIONS
4.1 Our Rights
If we determine that you have violated this Content Policy, we may, in our sole discretion:
Issue warnings or requests to cease prohibited activity
Suspend your access to the Service (temporarily or permanently)
Terminate your subscription or account
Remove or disable access to content that violates this policy
Report illegal activity to law enforcement
Take legal action to enforce this policy or recover damages
Cooperate with law enforcement investigations
4.2 Customer Consequences
If a Customer violates this policy:
We may immediately suspend or terminate Service access
Customer remains liable for all fees incurred before termination
Customer may be held liable for damages resulting from violations
We may notify affected End Users or relevant authorities
4.3 End User Consequences
If an End User violates this policy:
We may notify the Customer (venue operator)
The Customer may take appropriate action (e.g., removal from venue, law enforcement referral)
We may block the End User’s device from accessing the Service
Serious violations may be reported to law enforcement
4.4 No Liability for Enforcement
We are not obligated to monitor, review, or enforce this Content Policy. However, we reserve the right to do so at any time. We shall not be liable for:
Failure to detect or prevent policy violations
Actions taken or not taken to enforce this policy
User conduct or content on the Service
Consequences of suspending or terminating access
